Akta Kerja 1955: Cara Menyelesaikan Masalah atau Aduan Berkaitan Pengajian



Menteri Sumber Manusia V. Sivakumar berkata walaupun terdapat permintaan daripada pihak industri untuk memanjangkan tempoh penangguhan, namun terdapat juga keperluan untuk menguatkuasakan akta berkenaan.


Pada 26 Ogos lepas, Menteri Sumber Manusia ketika itu Datuk Seri M. Saravanan mengumumkan penangguhan penguatkuasaan pindaan Akta Kerja 1955 kepada 1 Januari 2023, sepatutnya berkuat kuasa 1 September lepas.




Akta Kerja 1955



Pindaan itu antaranya meliputi pengurangan tempoh waktu bekerja daripada 48 jam kepada 45 jam seminggu, penambahan cuti bersalin daripada 60 hari kepada 98 hari, cuti paterniti dinaikkan daripada tiga hari kepada tujuh hari dan larangan diskriminasi dalam pekerjaan.


Gaping gaji RM2000 telah dinaikkan kepada RM4000.00 bagi meningkatkan kebajikan pekerja golongan B40 dengan pindaan Jadual Pertama Akta Pekerja, yang digazet dan bakal berkuatkuasa mulai 1 Januari 2023.


2. Kelayakan Cuti Bersalin daripada 60 hari kepada 98 hari. Semua pekerja wanita yang bersalin tidak mengira tangga gaji dan melalui perkahwinan yang sah atau tidak, layak mendapat 98 hari dan Elaun Bersalin 98 hari.


4. Cuti Sakit dan Cuti Hospitalisasi adalah gabungan sebanyak 60 hari. Walaubagaimanapun, melalui Pindaan Akta Kerja 1955, Cuti Sakit (MC biasa) diasingkan dengan Cuti Hospitalisasi. Kelayakan Cuti Sakit berbayar 14/18/22 hari + Cuti Hospitalisasi 60 hari.


5. Cuti Paterniti sebanyak 7 hari. Maksimum sebanyak 5 kelahiran shj. (Sekiranya pekerja lelaki tersebut mempunyai 2/3 isteri, pekerja tersebut, hanya layak mendapat Cuti Peterniti berbayar maksimum 5 anak sahaja. Pekerja lelaki tersebut mestilah sudah berkahwin secara SAH dan hendaklah bekerja dengan majikan yang sama selama 12 bulan. Cuti Paterniti ini termasuk Hari Rehat dan Hari Kelepasan Am (PH).


7. Mewajibkan pihak majikan menampal notis bagi meningkatkan kesedaran berhubung Gangguan Seksual. Sebagai cth jenis gangguan seksual atau langkah2 yang perlu diambil sekiranya mendapat gangguan seksual di tempat kerja.


Terdahulu, Menteri Sumber Manusia, V. Sivakumar berkata penangguhan tersebut dilakukan bagi memberi laluan kepada industri dan majikan untuk pulih daripada kesan pandemik Covid-19, supaya mereka boleh bersedia untuk melaksanakan pindaan-pindaan yang telah ditetapkan dalam akta tersebut.


Tujuan pindaan ini adalah bagi meningkatkan dan menambah baik perlindungan dan kebajikan pekerja. Selain itu, ia juga bagi memastikan undang-undang perburuhan di Malaysia selaras dengan standard antarabangsa.


Namun begitu, wanita yang baru sahaja bersalin dibenarkan melaporkan diri lebih awal daripada cuti yang diberikan dengan syarat mendapat persetujuan daripada majikannya dan mendapat pengesahan daripada pengamal perubatan berdaftar tentang kelayakan dari segi kesihatan untuk bekerja semula.


Berdasarkan Pindaan Akta Kerja 1955, terdapat larangan penamatan perkhidmatan kepada wanita hamil. Penamatan hanya boleh dibuat berdasarkan tiga situasi iaitu pelanggaran syarat kontrak kerja, salah laku atau penutupan syarikat (bankrap).


Sebelum Akta Kerja 1955 dipinda, cuti sakit dan cuti hospitalisasi digabungkan dan dijumlahkan sebanyak 60 hari. Namun, mengikut Pindaan Akta Kerja 1955, cuti sakit (MC) akan diasingkan dengan cuti hospitalisasi.


Cuti paterniti terhad kepada lima kelahiran sahaja (tanpa mengira bilangan pasangan). Pekerja lelaki yang sudah berkahwin berhak mendapat paterniti cuti daripada majikannya sekiranya telah bekerja dengan majikan yang sama sekurang-kurangnya 12 bulan sebelum kelahiran anak.


Pekerja perlu melampirkan permohonan bertulis kepada majikan untuk meminta bayaran upah melalui bank atau cek dan tunai. Kemudian, majikan perlu mendapatkan kebenaran Ketua Pengarah (KP) sebelum meluluskan permohonan pekerja terbabit.


Setelah mendapat kelulusan KP di bawah seksyen ini, seseorang majikan hendaklah, memberikan KP butir-butir yang berkaitan dengan pekerja asing itu mengikut cara yang diarahkan oleh KP dalam masa empat belas hari dari tarikh penggajian pekerja asing.


Sebarang isu berkaitan diskriminasi pekerjaan yang timbul antara pekerja tempatan atau pekerja asing boleh disiasat oleh KP dan beliau berhak membuat keputusan dan mengeluarkan perintah bagi menyelesaikan isu tersebut.


Mana-mana majikan yang mengancam, menipu, menghalang atau memaksa pekerja untuk merupakan suatu kesalahan. Sekiranya disabitkan bersalah, majikan boleh didenda tidak melebihi RM100,000 atau dipenjarakan tidak melebihi dua tahun atau kedua-duanya sekali.


SHAH ALAM - Kongress Kesatuan Sekerja Malaysia (MTUC) mengesa kerajaan agar bertindak tegas terhadap mana-mana majikan yang melanggar Akta Kerja 1955 (Pindaan) 2022 sehingga pendakwaan perlu dilakukan.\r\r\rSetiausaha Agung MTUC, Kamarul Baharin Mansor berkata, ini kerana terdapat majikan mengubah terma perkhidmatan itu supaya waktu kerja adalah 45 jam.\r\rMenurutnya, pekerja tidak lagi dibayar upah bagi masa waktu rehat setelah pindaan baharu dibuat.\r\r\"Sebelum pindaan akta kerja, majikan membayar upah bagi waktu rehat tetapi setelah pindaan dibuat majikan tidak lagi berbuat demikian.\r\r\"Perlakuan majikan ini telah menyebabkan kemarahan pekerja kerana tempoh berada di syarikat tidak berubah,\" katanya dalam satu kenyataan pada Isnin.\r\rMedia melaporkan, kerajaan bersetuju untuk melaksanakan penguatkuasaan Akta Kerja 1955 (Pindaan) 2022 pada 1 Januari 2023.\r\rPindaan itu melibatkan pengurangan waktu kerja daripada 48 jam kepada 45 jam seminggu, penambahan cuti bersalin, cuti paterniti, waktu fleksibel dan banyak lagi telah memberi sinar baharu kepada kaum pekerja.\r\rTambah Kamarul Baharin, setelah seminggu penguatkuasaan dibuat, terdapat aduan
